Cancellation Of Removal

If you have been charged and detained by Immigration and Customs Enforcement (ICE), a deportation proceeding is likely to follow. Grounds for removal include:

  • Over-staying your tourist or student visa
  • Unlawfully entering the country
  • Staying in the country when you do not meet the requirements for a visa
  • Committing a crime

  • An accusation of falsely marrying a U.S. citizen

Cancellations of removal can be granted to both permanent and temporary residents who meet the requirements. For non-residents, you must show that you have lived in the U.S. for at least 10 years, have good moral character (no serious criminal convictions) and that an immediate family member who is a permanent resident would experience extreme hardship if you were deported.

In the case of a permanent resident convicted of a crime, the individual could be eligible for cancellation of removal if he or she has lived here for at least seven years and did not accrue the conviction in the first five years.
